नैनीताल। यूसीसी पर विपक्ष व अन्य संगठनों के विरोध के बाद हाईकोर्ट की टिप्पणी राज्य सरकार के लिए सुकून भरी खबर है। बीस फरवरी को कांग्रेस ने समान नागरिक संहिता के मुद्दे पर विधानसभा घेराव का ऐलान किया है। इससे पूर्व हाईकोर्ट ने यूसीसी पर दाखिल याचिका पर सुनवाई करते हुए लिव इन रिलेशन के पंजीकरण पर मुहर लगाई।
हाई कोर्ट के मुख्य न्यायाधीश न्यायमूर्ति नरेंद्र की अध्यक्षता वाली खंडपीठ ने समान नागरिक संहिता (यूसीसी) में लिव-इन संबंधों के अनिवार्य पंजीकरण को चुनौती देती युवक की याचिका पर मौखिक टिप्पणी की। न्यायालय ने कहा कि राज्य सरकार ने यह नहीं कहा है कि आप साथ नहीं रह सकते हैं। जब आप बिना शादी के निर्लज्जता से एक साथ रह रहे हैं, तो रहस्य क्या है? इससे किस निजता का हनन हो रहा है? राज्य सरकार लिव-इन संबंधों पर रोक नहीं लगा रही है, बल्कि पंजीकरण की शर्त लगा रही है।
दो दिन पहले हाई कोर्ट की इस टिप्पणी के बाद राज्य सरकार को राहत मिली है, जो 27 जनवरी को यूसीसी लागू होने के बाद इसके विरुद्ध दायर हुई सात रिट याचिकाओं के चलते सवालों के घेरे में आई थी। पुष्कर सिंह धामी सरकार के लिए यह एक राहत भरे कदम के रूप में देखा जा रहा है।
याचिकाकर्ता के अधिवक्ता अभिजय नेगी ने सुप्रीम कोर्ट के 2017 में पारित निर्णय का हवाला देते हुए निजता के अधिकार पर जोर दिया। उन्होंने तर्क किया कि उनके मुवक्किल की निजता का हनन हो रहा है, क्योंकि वह अपने साथी के साथ लिव-इन रिलेशनशिप की घोषणा या पंजीकरण नहीं करना चाहता है।
मुख्य न्यायाधीश न्यायमूर्ति नरेंद्र और न्यायमूर्ति आलोक मेहरा की खंडपीठ ने उनके तर्क का खंडन करते हुए कहा कि यूसीसी किसी भी घोषणा का प्रविधान नहीं करती है। यह केवल लोगों से ऐसे रिश्ते के लिए पंजीकरण करने के लिए कह रही है।
मुख्य न्यायाधीश ने टिप्पणी की, “क्या रहस्य है? आप दोनों एक साथ रह रहे हैं। आपका पड़ोसी जानता है, समाज जानता है, और दुनिया जानती है। फिर आप जिस गोपनीयता की बात कर रहे हैं, वह कहां है? क्या आप गुप्त रूप से, किसी एकांत गुफा में रह रहे हैं? आप नागरिक समाज के बीच रह रहे हैं। आप बिना शादी किए बेशर्मी से साथ रह रहे हैं। फिर वह कौन सी निजता है, जिसका हनन हो रहा है?”
बहस के दौरान याचिकाकर्ता ने अल्मोड़ा की एक घटना का हवाला दिया, जहां एक युवक की हत्या सिर्फ इसलिए कर दी गई क्योंकि वह अंतरधार्मिक लिव-इन रिलेशनशिप में रह रहा था। हाई कोर्ट ने मौखिक रूप से याचिकाकर्ता से कहा कि वह लोगों को जागरूक करने के लिए कुछ काम करें।
खंडपीठ ने आगे कहा कि इस मामले को यूसीसी को चुनौती देने वाली अन्य याचिकाओं के साथ जोड़ा जाएगा। यदि किसी के विरुद्ध कोई दंडात्मक कार्रवाई की जाती है, तो संबंधित व्यक्ति अदालत में आ सकता है। मामले में केंद्र और राज्य सरकार को नोटिस जारी करते हुए अगली सुनवाई पहली अप्रैल को नियत की गई है।
